（一） 汇票

汇票（Draft,Bill of Exchange）是一人向另一人签发的无条件的书面付款命令。要求受票人（Drawee）按照汇票上所列的期限、金额向汇票规定的收款人（Payee）或其指定的人或持票人进行支付。在信用证中，汇票主要是起一个付款凭证的作用。

1．信用证汇票条款示例：

2．汇票填制要点：

1）汇票号码----通常与此笔交易的发票号码一致，以便核对。

2）汇票日期----一般是提交议付的日期，该日期往往由议付行填写。该日期不能迟于信用证的有效期。

3）汇票金额----根据信用证规定的金额填写。一般信用证中的规定是按发票金额的100%开立汇票，有时也有按发票金额的一定百分比开立的（如上例4）。在填写汇票金额时要注意金额的大小写要一致，而且货币的币种要与信用证金额货币相同。

4）汇票期限----在汇票中用“At…“表示。

*即期汇票“At Sight…”.只须在横线上用“* * * * * * *”或“-------------”表示，也可以直接打上“At Sight…”。（但不要留空）

*远期汇票。按信用证汇票条款的规定填入相应的付款期限。

例如：“30 days after sight”, 见票后30天付款。

“45 days after sight”, 汇票出票日后45天付款。

“60 days after the B/L date”, 提单日后60天付款（注意：此时应

在“B/L date”后加注实际的提单日期）。

5）收（受）款人（Payee）。在汇票中一般用“Pay to the order of …”或，“Pay to … order ”来表示。通常，在信用证支付条件下收款人填信用证议付行的名称。

例如：“Pay to the order of Bank of ChinaShanghai Branch”

6）对价条款----应填入有关货物的数量、包装、及品名。

例如：“”

7）出票条款----应填写相关信用证开证行、信用证号码及开证日期。 例如：“Drawn under The National Bank of Kuwait S.A.K.Head Office

”

8）付款人（Payer）即受票人（Drawee）。一般此栏在汇票中用“To”表示。汇票付款人的填写要按照信用证的要求，在信用证汇票条款中付款人往往是用“drawn on …”或直接用“on…”表示的。

例如：*汇票条款中规定：…drawn on us “或“…on ourselves”

则付款人为开证行

*汇票条款中规定：“… drawn on ××bank”(非开证行)

则付款人为该银行（即信用证的付款行）

*汇票条款中规定：“?on yourselves”

则付款人为通知行，而此时，通知行往往又是信用证的保兑行。 注意：汇票付款人也可是开证申请人或其他公司企业。一般而言，付款人应按信用证的规定填上详细的名称地址。

9）出票人（Drawer）。在汇票右下角，一般填信用证受益人，并且受益人在出具了汇票后必须签署。

(二)受益人申明/证明

受益人申明/证明是信用证受益人根据信用证的有关规定缮制的一种比较简单的议付单据.

1.信用证受益人申明/证明条款示例:

1) Beneficiary’s Certificate certifying that full set of non-negotiable copies of documents to be sent to Applicant immediately after shipment.

2) Beneficiary’s Statement indicates that cable copy of shipping advice dispatched to the accounted immediately after shipment.

3) Beneficiary’s Declaration stating that one complete set of non-negotiable shipping documents sent directly to the opener by express airmail within 2 days after shipment.

4) Beneficiary’s Certificate certifying that each export package to be marked with “MADE IN CHINA”.

2.受益人申明/证明填制要点:

1) 名称_按信用证的规定.

2) 日期_受益人申明/证明的日期应与证明内容相吻合.例如:提单日期是3月12日.受益人证明的有关内容是”We hereby certify that one set of non-negotiable shipping documents has been airmailed to the Applicant within 2 days after the shipment date.”则受益人证明的日期不能早于3月12日,当然也不能晚于交单日期.

3) 内容_受益人申明的内容应根据信用证缮打.但有时应对所用时态作相应变化.例如:信用证条款规定:”Beneficiary’s certificate certify that all the all the packages to be lined with waterproof paper and bound with two iron straps outside.”则受益人证明应作成:”^packages have been lined^”(转载于:www.hNNsCy.coM 博 文 学 习 网:受益人证明书)

4) 签署_受益人证明应注明出证人的公司的名称并签章.
